With the judgement of the Supreme Court judgment granting fiscal autonomy to Local Governments Areas (LGAs), a former commissioner for justice in Oyo State, Oluwaseun Abimbola, has called on governors to ensure the court’s decision is obeyed.
Mr Abimbola, in an interview on Sunday, August 11, 2024, said it is important that governors across states do not only obey the court’s decision but start making plans for the implementation of LG autonomy in their respective states.
Reacting to the decision by the Oyo State government to review the judgment and take an action that is suitable to its desire, Mr Abimbola said it would be wrong for states to act in contrast to the decision of the Supreme Court’s decision.
He said, “For any sub-national like a state or local government to say that it would act contrary to the supreme court judgment is absolutely wrong.
“The constitution states that you have to abide by any decision made by the apex court.
“In fact, the state too, can have its own law that people can disagree with, but they must obey it. That is democracy,” he said.
Stating that rather states disobeying the judgment, the court may find reasons to do so on its own because there are instances in the past where the Supreme Court came back to overrule itself on some decisions.
